These Terms of Use ("Agreement") govern the access and use of the services and content provided by “Optima Learn" (“Company”, “we”, “us”, or “our”), through the website located at www.optimalearn.com (the “Platform”). This is a legally binding agreement between you (“User”, “you”, or “your”) and the Company. By using the Platform, whether as a Free or Premium User, you agree to be bound by these Terms. If you do not agree, you must refrain from accessing or using the Platform.
1. Eligibility and Account Use
- You must be at least eighteen (18) years of age, or accessing the Platform under the supervision of a parent or legal guardian.
- You are solely responsible for any and all activities that occur under your account.
- User accounts are personal, non-transferable, and intended solely for individual educational and training use.
2. User Categories and Access Levels
Users are classified as follows:
- Free Users: Individuals who access the Platform without payment. Free Users may be provided access to mock tests, selected content, blogs and basic study features as determined by the Company.
- 100+ Full-Length Mock Exams: Simulate real CAT conditions and track performance.
- Private WhatsApp Community: Peer and mentor support, updates, and daily guidance
- All Previous Year CAT Questions: Practice and analyze past questions to boost accuracy
- Full General Study Planner: Structured daily tasks, milestone tracking, and customized strategies
- Premium access is granted upon successful payment and may be subject to verification. Access duration is based on the selected subscription plan.
3. Platform Ownership and Permitted Use
- All content, except Third-Party Content as defined below, on the Platform including questions, mock tests, dashboards, algorithms, reports, designs, and study materials is the exclusive property of Optima Learn.
- You may not copy, distribute, share, reverse-engineer, or commercially exploit any part of the Platform or its content.
- Access is provided under a limited, non-exclusive, non-transferable, revocable license for personal use only.
4. Third-Party Content and Attribution
- The Platform may include embedded or linked content from third-party providers, such as YouTube videos, public articles, or other educational references.
- The Company does not claim ownership of any third-party content and disclaims any responsibility for its accuracy or availability. Disclaimer which is also displayed with such content:
- Certain content on the Platform, including but not limited to mock tests, theory notes, and explanations, may be curated or generated using artificial intelligence (“AI”) tools based on publicly available materials and data sources from the internet. While efforts are made to ensure relevance and accuracy, the Company does not guarantee the completeness, originality, or correctness of such AI-generated content. 5. Modifications to Services
- We reserve the right to modify, update, suspend, or discontinue any part of the Platform, including free and paid features, at our discretion, without prior notice.
- Analytics, scores, and study recommendations may be generated using AI and are for guidance only.
6. Payment, Fees & Refund Policy
- Access to Premium features is subject to successful payment through authorized methods.
- Payments are non-transferable and non-refundable by default.
- All refund requests are subject to verification. The Company reserves the right to deny incomplete or non-qualifying claims.
7. Data Collection and Privacy
- We collect data such as your name, email, academic profile, and study behaviour to personalize your learning experience.
- Personal data is not sold. It may be shared with vetted partners under confidentiality for Platform improvement.
- Mentor Google Calendar Integration (optional): Mentors may voluntarily connect their Google Calendar so that Optima Learn can create, modify, and delete the calendar events for sessions students book with them. We request only the
calendar.eventsscope (plusopenidandemailto identify the connected account) and never read other events on the mentor's calendar. Refresh tokens are stored encrypted at rest. Use of data received from Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements. Mentors may revoke this access at any time from the mentor home page on Optima Learn or from https://myaccount.google.com/permissions. - Please refer to our Privacy Policy for full details.
8. User Responsibilities
You agree not to:
- Share your account or login credentials.
- Reproduce or extract Platform content or tools.
- Use bots, scripts, or automation.
- Falsify academic or personal details.
- Attempt to disrupt or breach Platform security.
9. Disclaimer of Warranties
- The Platform is provided “as is” and “as available”without warranties of any kind.
- We do not guarantee:
- Exam results or exam percentile outcomes.
- Platform uptime or uninterrupted service.
- Accuracy of mock scores, plans, or AI recommendations.
10. Limitation of Liability
To the extent permitted by law, Optima Learn shall not be liable for indirect, incidental, or consequential damages, including:
- Loss of academic performance or opportunities.
- Service interruptions or data loss.
- Errors in scoring or feedback mechanisms.
11. Intellectual Property
- All intellectual property on the Platform including branding, code, logic, algorithms, and educational content is owned by Optima Learn. Data collected through engagement, logic for the code.
- Unauthorized use, copying, tampering, or resale is strictly prohibited.
- Where the Platform includes references to Third-Party content, appropriate credits and attributions are provided wherever applicable. Optima Learn does not claim ownership over such Third-Party material. Content owners who believe their work has been used without due acknowledgment, or who wish to request attribution corrections or removal, may contact us at contact@optimalearn.in. All such requests will be reviewed and addressed in good faith.
12. Account Termination
We may suspend or terminate your account if:
- You violate these Terms.
- Misuse, manipulation, or abuse is detected.
- Required by law or court order.
13. Jurisdiction and Dispute Resolution
- This Agreement is governed by the laws of India.
- All disputes arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be attempted to be resolved, in good faith, first through mediation.
- If unresolved within 30 days, either party may initiate legal proceedings.
- All disputes shall be subject to the exclusive jurisdiction of courts in Delhi, India, only.
